2. Information We Collect
2.1 Information You Provide Directly
- Vehicle Inquiry Information: When you submit a "Check Availability" or inquiry form, we collect your first name, last name, email address, phone number, and comments/message. This information is collected for the purpose of connecting you with the dealer whose vehicle you are interested in.
- Dealer Registration Information: When a dealership registers for a dealer account, we collect the contact person's name, email, phone number, dealership name, address, city, state, ZIP code, and website URL.
- Contact Form Submissions: When you submit a general contact form or dealer partnership request, we collect your name, email, phone, and message content.
- Account Information: Account credentials (email and hashed password) for admin and dealer portal users.
- Payment Information: When dealers make purchases through the Service, payment is processed by Stripe, Inc. We do not store your credit card number or full payment details on our servers. We store transaction records including order amounts, Stripe session IDs, and payment status.
2.2 Information Collected Automatically
- Usage Data: Pages viewed, search queries, vehicle listings viewed (VDP views), click events, referring URLs, and time spent on pages.
- Device and Browser Information: IP address, browser type and version, operating system, device type, and user agent string.
- Analytics Data: We generate privacy-conscious visitor fingerprints using hashed combinations of your IP address, date, and user agent for analytics purposes. We also track session identifiers.
- UTM and Campaign Data: Marketing attribution parameters (utm_source, utm_medium, utm_campaign, utm_content, utm_term) from URLs you use to access the Service.
- Cookies and Similar Technologies: We use session cookies to maintain your login state and store temporary preferences. We may also use third-party analytics and tracking scripts (such as Google Analytics) configured through our platform.
3. How We Use Your Information
3.1 Consumer Lead Information
When you submit a vehicle inquiry, your information is used to:
- Share with the applicable dealership so they can contact you regarding the vehicle you inquired about, related vehicles, financing, trade-in opportunities, and other dealership services
- Facilitate contact via telephone (including autodialed and prerecorded calls), text messages (SMS/MMS, including automated messages), and email from both OnlineCarList and the dealer or their agents
- Store a record of the inquiry including vehicle details, a photo of the vehicle, and dealer information at the time of submission for our records and platform analytics
- Send you notifications related to your inquiry and the Service
Your inquiry data, once shared with a dealer, is subject to that dealer's privacy practices. We are not responsible for how dealers handle your information after it has been transmitted to them.
3.2 Dealer Information
Dealer account information is used to:
- Create and manage dealer portal accounts
- Match incoming leads to the appropriate dealership by phone number
- Process purchases of lead unlock credits and advertising plans
- Provide customer support and account management services
- Send transactional emails (account verification, password resets, new lead notifications, order confirmations)
- Generate analytics and performance reports for the dealer
3.3 General Uses
We use collected information to:
- Provide, operate, and maintain the Service
- Improve, personalize, and expand the Service
- Monitor usage patterns and analyze trends
- Detect, prevent, and address fraud, abuse, and technical issues
- Comply with legal obligations and enforce our Terms of Service
- Communicate with you about service updates, security alerts, and support
4. How We Share Your Information
We may share your information in the following circumstances:
- With Dealerships: Consumer inquiry data (name, email, phone, comments, vehicle details) is shared with the dealership whose listing generated the inquiry. This is the core purpose of the Service.
- With Service Providers: We share information with third-party service providers who perform services on our behalf, including Stripe (payment processing), email delivery services, and hosting providers. These providers are contractually obligated to use your information only as necessary to provide services to us.
- With Data Providers: Vehicle listing data is sourced from third-party providers such as MarketCheck and LotLinx. We share anonymized analytics data with these providers for inventory management purposes.
- For Legal Compliance: We may disclose your information when required by law, legal process, litigation, or requests from public and governmental authorities.
- Business Transfers: In the event of a merger, acquisition, reorganization, bankruptcy, or sale of all or a portion of our assets, your information may be transferred as part of that transaction. We will notify you via email or prominent notice on the Service before your information becomes subject to a different privacy policy.
- With Your Consent: We may share your information for other purposes with your explicit consent.
We do NOT sell your personal information to data brokers, marketing companies, or other third parties for their own marketing purposes.
5. Data Retention
We retain your personal information for as long as necessary to fulfill the purposes described in this policy, unless a longer retention period is required or permitted by law. Specifically:
- Lead data: Retained indefinitely for dealer access, analytics, and business records, unless you request deletion.

- Analytics data: Retained for up to 36 months for trend analysis and reporting.
- Payment records: Retained as required by applicable tax and financial regulations.
6. Data Security
We implement commercially reasonable administrative, technical, and physical security measures to protect your personal information, including:
- Passwords are stored using bcrypt hashing (never in plain text)
- Database access is restricted to authorized personnel and systems

7.1 Access and Correction
You have the right to request access to the personal information we hold about you and to request correction of any inaccurate information. Dealers can update their information through the dealer portal settings page.
7.2 Deletion
You may request deletion of your personal information by contacting us at support@onlinecarlist.com. Please note that we may retain certain information as required by law or for legitimate business purposes (such as fraud prevention and financial record-keeping). Once lead data has been shared with a dealer, we cannot control or delete copies held by that dealer.
7.3 Opt-Out of Communications
You may opt out of receiving promotional communications by:
- Replying STOP to any text message
- Clicking the unsubscribe link in any marketing email

Please note that you may still receive transactional messages (such as inquiry confirmations) even after opting out of promotional communications.
7.4 Do Not Track
The Service does not currently respond to "Do Not Track" browser signals. However, you can control cookies through your browser settings.
8. California Privacy Rights (CCPA)
If you are a California resident, you have the right to:
- Know what personal information we collect, use, disclose, and sell
- Request deletion of your personal information
- Opt out of the sale of your personal information (we do not sell personal information)
- Not be discriminated against for exercising your privacy rights

The Service is operated in the United States. If you access the Service from outside the United States, your information will be transferred to, stored, and processed in the United States. By using the Service, you consent to the transfer of your information to the United States.
